7 Days of Pro-Employer Labor Law Reforms Proposed by Senate GOP – Day 1: Workers RESULTS Act
Aims to strengthen “worker choice” and tighten election rules.
Key Changes:
* Secret-ballot only: Eliminates voluntary recognition/card check. Requires NLRB-run elections with a 2/3 turnout quorum and majority of votes cast.
* Election timing limits: Petitions allowed only when no contract exists or during a 90-day window every 2 years; plus a 90-day decertification window if a union fails to bargain in good faith.
* Successor bar eliminated: New owners cannot rely on mergers/acquisitions to block challenges to union representation.
* Blocking charges curtailed: ULP charges used to delay elections must include offers of proof and witnesses; ULP settlements cannot block elections. Speeds timelines, reducing union ability to pause elections.
