NLRB Quickie Elections Rules Take Effect Today

Today is an important day at the NLRB. Today is December 26. The day after Christmas. The week between Christmas and New Years. When many businesses are closed. When many employees take off work to spend time with family. When most people don’t pay attention to the news.

Today is also the day NLRB Quickie Elections rules take effect. A resurrection of the ambush elections from Obama’s NLRB. Interesting that the NLRB, who can control when its rules take effect, chose today to revive this rule.

Today is also the day Employers are faced defending against a 3-headed monster. A trifecta of pro-union election laws. A perfect storm to significantly increase union presence in America.

Today the quickie election rules join the Cemex ruling that makes card check (almost) the defacto organizing method and the micro units law allowing for the smallest possible bargaining unit.

Today begins open season for union organizing.

I suspect many unions have the requisite number of authorization cards necessary for a union election but have been waiting for now to go public with their cards. I suspect demands for recognition and petitions for elections will increase in the near future.

Today, I hope my suspicions are wrong.
